COURT DENIES GENERIC'S APPLICATION FOR SUMMARY JUDGEMENT ON PRILOSEC® PATENT

AstraZeneca announced today that the United States District Court for the Southern District of New York has denied a summary judgement motion filed by Reddy-Cheminor alleging invalidity of a patent (US patent no:4,255,431) at issue in a lawsuit. The patent relates to omeprazole, the active ingredient in Prilosec®, a treatment for stomach acid disorders.

  • The company received a written request from the FDA on July 1, 1999, for paediatric studies with Prilosec®, in accordance with the Federal Food, Drug and Cosmetic Act. The Act grants a six-month period of exclusivity after scheduled patent expiration to pharmaceutical manufacturers, which provide paediatric safety and efficacy data for certain medications.
